These Terms of Use (“Terms”) govern access to and use of the Budhiam platform, account creation and management, booking of sessions, safety and conduct rules, as well as payment, suspension and termination. They apply to all users of the Budhiam™ mobile application and/or related web services (the ‘Platform’), including but not limited to Budee and Hiamee roles.

Budhiam, published by Callean Media LTD (United Kingdom), is a technical matchmaking platform connecting users for human listening sessions that are strictly non-therapeutic and non-medical, and do not constitute diagnosis or professional advice (legal, financial, medical, etc.).

• Publisher / Budhiam: Callean Media LTD operating the technical intermediation Platform.  • User: any individual holding a Budhiam account. • Budee: a user booking a human listening session via the Platform.  • Hiamee: a user offering availability to conduct a human listening session, acting autonomously and under their own responsibility.  • Session: a moment of dialogue and active listening at a time, place and duration agreed within the Platform and called " Café Confidence, 

Budhiam acts exclusively as a technical intermediary: it is not the employer, agent, or guarantor of users. Each Hiamee and Budee acts independently and remains solely responsible for their decisions and conduct before, during and after the Session. To the extent permitted by law, Budhiam shall not be liable for users’ acts, omissions, negligence, or misconduct, particularly outside the strictly defined contractual framework and/or the agreed place and time.

Use of the Platform requires full, express and unconditional acceptance of these Terms, evidenced upon account creation and reiterated upon each booking. Accessing or using the Platform constitutes acceptance of the then-current Terms.

These Terms apply to all services, interfaces, content and features provided by Budhiam (mobile apps, web space, APIs). Where a Session is covered by a Service Agreement/Contract electronically signed on the Platform, the specific provisions of such contract supplement the Terms; in case of inconsistency, the specific provision prevails for that Session

Sessions are not a substitute for medical, psychological, legal, financial or other professional support; in distress or danger, Users must contact the appropriate services. Budhiam does not guarantee any outcome or fitness for a particular purpose; the service is provided “as is.”

Budhiam processes only the data strictly necessary for matchmaking, booking management, billing and contract execution, applying appropriate technical and organisational measures and respecting data subject rights (access, rectification, erasure, etc.).

Unless otherwise provided in the final provisions, these Terms and related agreements are governed by UK law, and a mandatory prior mediation mechanism may apply before any court action. (Full details appear in the “Governing Law – Mediation – Jurisdiction” clause of the Terms.)

Budhiam only collects the data strictly necessary for the proper functioning of the Application, including: identity, profile photo, temporary geolocation, meeting history, check-ins, and technical data relating to the use of the Application.

This data is used exclusively to: • ensure the safety of Users; • validate the occurrence of meetings and enforce the Terms of Use; • manage payments and contractual obligations; • provide technical support and customer assistance. No data is used for advertising, commercial, or unrelated tracking purposes.

Geolocation is only activated 10 minutes before and 10 minutes after each meeting, solely for the purpose of verifying the presence of both parties at the agreed location and ensuring their safety. Outside this scope, no continuous tracking is carried out.

In accordance with the UK GDPR and the Data Protection Act 2018, each User has the right to access, rectify, erase, object to, and port their personal data. Any request must be submitted via the form available within the Application or in writing to the official address of Callean Media Ltd.

Data is stored for a maximum period of 12 months following the last use of the Application, unless otherwise required by law or in the event of a dispute necessitating longer retention.

All data is stored in encrypted form. Access is strictly limited to authorised Budhiam staff. In the event of a security alert or dispute, certain data (session logs, check-ins, validation selfies, geolocation) may be transmitted to the competent authorities, in compliance with applicable law.

Security and trust lie at the heart of the Budhiam experience. This is why we created BudID, a dedicated identity verification portal inspired by international best practices and leading solutions such as Persona. Its purpose is to guarantee a reliable, protected, and authentic environment where every member can interact with confidence. The role of BudID is twofold. First, it ensures that each account truly belongs to a real person, in line with our commitment to transparency and sincerity. Second, it protects the community against abusive behavior, fake profiles, and identity fraud. In a digital context where anonymity can undermine trust, BudID sets a clear standard: everyone is welcome to express themselves, but always behind a verified account. The BudID verification process has been designed to remain simple, fast, and respectful. Users are guided step by step through a smooth journey that only takes a few minutes. An official ID document is required and may, in some cases, be paired with a live selfie to confirm the match. All documents are processed through top-tier security protocols: end-to-end encryption, secure server hosting, and automatic deletion once verification is complete. Confidentiality is absolute. The BudID verification process is powered by a secure artificial intelligence system, with no direct human intervention, thereby eliminating any risk of manipulation or unauthorized access. Only the information strictly necessary for validation is analyzed, using advanced encryption protocols. Data is never stored beyond the technical period required for verification, in full compliance with GDPR and international privacy standards. The sole objective is to protect users and guarantee the authenticity of profiles — never to build commercial or intrusive profiling. BudID is built on an inclusive and fair approach. Verification is completely free, with no subscription requirements or hidden paid options. It is not a commercial product but rather a foundation of trust designed for the benefit of the entire community. By verifying their account, each member contributes to creating a safer, more transparent, and more human space for interaction. In short, BudID is far more than a technical tool. It is a statement of values: authenticity, security, and respect. By joining Budhiam with a verified account, every user actively contributes to a culture of trust, where interactions reclaim their true dimension — genuine human connection, free of masks and free of artifice.

Budhiam, operated by Callean Media Ltd, acts solely as a technical intermediary enabling connections between Users (“Budee” and “Hiamee”). The Platform provides a framework, security tools, and a booking system, but does not intervene in any exchanges, behaviours, or actions of Users during meetings. Budhiam does not supervise, monitor, or record communications between Users, except in cases strictly required by law or security.

Budhiam shall in no event be held liable for: • the words, attitudes, gestures, or behaviour of Users; • any dispute, disagreement, or incident occurring before, during, or after a meeting; • any material, immaterial, physical, or moral damage caused between Users; • any fraudulent, abusive, or improper use of the Application by a User or a third party. Each User expressly acknowledges that they are solely responsible for their actions and behaviour within the services provided. This limitation shall not affect Budhiam’s obligations relating to data protection and lawful processing.

Both Budee and Hiamee agree to comply with applicable laws, these Terms of Use, and the Partnership Agreement where applicable. In the event of a breach, the responsible User shall bear sole liability for their acts and consequences.

Budhiam shall not be held liable for any failure or delay resulting from a case of force majeure (as defined by English case law) or from events beyond its control (technical breakdown, network interruption, malfunction of third-party services, etc.).

In the event of a serious incident, Budhiam reserves the right to transmit to the competent authorities any data necessary for the identification of the Users involved (logs, check-ins, photos, geolocation), in compliance with applicable legal provisions.

These Terms of Use shall take effect as of this date. Any update will be published within the Application and on Budhiam’s official website. Users will be informed of any material changes via in-app notification or by email, at least 15 days prior to their entry into force. Budhiam Callean Media LTD
